摘要
Liability based on fault was the Romanian standard of reference for tort liability. The rule from the new civil code enacting a liability regardless of any fault appears in the context of modernisation of national legislation and raises the problem of the criteria relevant for this legal institution. Through an historical-conceptual incursion in common law and French law, we intend to highlight the changes that imposed objective liability, absent of any fault. The provision from the code affirms itself in correspondence with European law, having deep social and legal implications.
