摘要
The objective of this research is to analyze the right to education, focusing on environmental education, as it's recognized as a fundamental right. The right to education is studied in it's construction over time, and it's recognition as a social right and fundamental right by the brazilian Constitution. An overview of the issues of the right to education is given for then study the right to environmental education, it's evolution as a right and it's realization as a fundamental right recognized by the Constitution. Also, the monographic method of research procedure is adopted, with doctrinal and jurisprudential analysis. So that at the end it can be recognized that by guaranteeing the highest possivle number of accesses to formal education, it enables not only the realization of the right to education, but also the realization of the fundamental right to environmental education.
