THE IMPACT OF NATIONALLY DETERMINED CONTRIBUTIONS ON THE INTERPRETATION OF THE PARIS AGREEMENT THROUGH SUBSEQUENT PRACTICE

With the adoption in 2015 of the Paris Agreement on climate change, a new model is established that seeks a more effective fight against climate change. In this way, the bottom-up approach that is enshrined through the technique of Determined Contributions at the National Level, supposes a procedural obligation to all the States Parties to the treaty. That is why, given the lack of definition of the content to be determined by each State and, therefore, with a wide margin of discretion, it seems interesting to determine to what extent from the determination of the international legal obligation a subsequent practice will arise that assist in the interpretation of the international legal instrument itself, in accordance with the rule established in Article 31 of the Vienna Convention on the Law of Treaties. Bearing in mind that one of the characteristics of the Paris Agreement is its lack of precision in many of its provisions.
