摘要
In today's european development, the evolution of the concept of legislative codification, accepting international jurisdictions, have decisive influence on the laws of the member states of the European Union, concerned with the harmonization and adaptation to the new provisions. From the perspective of criminal law, the idea of a single European legislation was not developed as much as for other areas, as manifested especially in the international judicial cooperation, but it is obvious mutual influence between criminal law and community law in the context of the principles general unanimously accepted. This approach aims to highlight the role that meets the European Court of Human Rights and the European Court of Justice in this complex court system and how these courts case law and regulations contribute to the harmonization of Romanian criminal law.
