Limits on the exercise of conventionality control and application of international standards by state courts: The Peruvian case

摘要
The present article studies the role of Peruvian justice bodies in the respect and guarantee of human rights, analyzes the application by the Peruvian judiciary of the control of conventionality and the observance of the international standards established by the Inter-American Court of Human Rights, identifying the principles that it applies in this task, such as pro-persona and useful effect principles, its role in compliance with the judgments of said court, and its legal framework. As well as, the application, by the Peruvian judiciary, of the international standards established in the case of De La Cruz Flores to the case of Luis Pollo Rivera and the supervision of compliance with the De La Cruz Flores case (2004) vs Peru. Finally, this paper questions the interpretation that Peru makes when invoking and/or applying standards of the Inter-American Court of Human Rights, in the exercise of control of conventionality and in the enforcement of its judgments.
