End-of-life decisions are based upon prognosis and the patient's (supposed) choice. German law (3rd Amendment to the Federal Guardianship Law; also "Advance Directives Act", 2009) allows for withdrawal of therapy in cases of poor prognosis or unacceptable prognosis in view of the patient's life values. Advance directives, however, can be contrary to a concurrent wish for post mortem organ donation. Legal directives for weighing the two contrary positions (withdrawal of life-sustaining therapy vs. organ-sustaining therapy in preparation for organ donation) are lacking. To avoid unintended risks for the patient such as a prolongation of the dying process, but also to facilitate a patient's wish for organ donation, the Clinical Ethics Committee at Goethe University, Frankfurt, has developed a guideline to support physicians in the decision process.
