摘要
The case-law of the European Court of Human Rights is based in several interpretation criterion: a) The principle of indivisibility of fundamental rights; b) The principle of equality and non-discrimination; and c) The connection of the rights, interpretation criterion that allows the European Court of Human Rights to integrate rights not specifically covered by the Convention. The European Court of Human Rights understands the European Convention of Human Rights as an alive instrument, that has to be interpreted within the facts and the timing of each case. The European Court of Human Rights legal doctrine in the application and interpretation of the European Convention on Human Rights has allowed to draw essential principles in the social market economy. We have many examples. This paper seeks to explore the social dimension of the property right, the right to a fair trial within a reasonable time, the right of appeal and the right to equality and nondiscrimination.
