摘要
This paper is based on the question of whether the effectiveness of non-specific fundamental rights of public employees, in the light of the digitisation of labour relations, is subject to greater limitations than that of conventional workers. For this purpose, the control of police activity is used as a case study. The main conclusion is that, while the same general rules apply, the general interests served by these public employees, and the existence of other legal assets at stake, allow for more intense and permanent control. However, data protection regulation, in particular the principles of purpose limitation and minimum intervention, provides tools to ensure the effectiveness of the fundamental rights of these workers.
