LAW ENFORCEMENT AGAINST POLITICAL PARTIES' CORPORATE CRIME: THE INDONESIAN LEGAL PERSPECTIVE

摘要
There have been several alleged cases of corruption involving political party members in Indonesia whose proceeds flowed to their parties, but no political party has yet been prosecuted by law enforcement. This research aims to analyze criminal acts of corruption committed by political parties as corporations and to analyze law enforcement against political party corporations that commit criminal acts of corruption. This research is categorized as normative legal research (non-doctrinal). Results showed that criminal acts of corruption committed by political parties as corporations should be prosecuted. There are currently no sanctions against political parties although they actually fulfill the elements of perpetrators of corruption. There are several types of law enforcement against political party corporations that commit criminal acts of corruption. Based on Article 20 of the Amended Corruption Law the form of sanctions against political parties is only a fine with the maximum penalty plus a third of it.
