摘要
This contribution will first offer a background overview of the European Union's rule of law crisis by outlining its genesis before addressing some conceptual issues and in particular, how those undermining the rule of law have also sought to prevent European Union action by challenging inter alia the binding nature and enforceability of EU rule of law requirements. Poland will then be used as a case study to illustrate the reality of the European Union's rule of law crisis.
