摘要：

This paper analyzes the history of the Brazilian Supreme Court in chronology with the history of Brazil, in a period between the arrival of the Portuguese in Brazil until the Estado Novo of Getulio Vargas. Using the method of bibliographic review, stemming from rare books, eminently Brazilian, to understand the reasons that erupted in the creation of the Brazilian Supreme Court, having the antecedents as a fundamental basis. In addition to what this institution is nowadays, we sought to establish the historical guidelines, its roots in the Brazilian Empire and its development in the Brazilian Republic until Vargas Government, in order to demonstrate that the creation of the Brazilian Supreme Court was carried out without effective support, in practice, with no autonomy.
