A Departure from the Anthropocentric Vision of the Rights of Non-Human Victims and the Importance of the Worldview of Indigenous Peoples

摘要
The advance in the scope and interpretation of rights has allowed that more guarantees are provided for human beings, such as a national and international way like the very notion of the subjects of rights. In this sense, currently, protection has been expanded to cover called non-human beings, such as animals, rivers or plants. Regarding these new trends, it is value to ask: Is this a new understanding of rights due to a true change of perspective that conceives non-human beings as subjects of rights? Or, in the contrary, the new trends continue to respond to recognize the rights of non-human beings because it is possible that the damage to them directly or indirectly affects human beings? The answer to this last concern is relevant, given that it determines both the scope of protection to non-human beings as well as forms of reparation. Therefore, this text aims to expose the rights of non-human beings proposing that a vision different from the traditional anthropocentric one, such as indigenous worldview, can allow a better understanding of the rights of the non-human beings and their right to reparation.
