摘要
This paper starts with the concept of governmentality in Foucault to think of a notion of a State at the present time without rigid borders and that goes beyond the dichotomy between legal and illegal. To this end, the notion of Empire in Hardt and Negri is briefly used, and the central character of the police institution is reinforced. It then addresses the relationship between State power and the militias through the genealogy developed by Elsa Dorlin of the so-called "legitimate self-defense", understood as being the basis of the social contract itself. Finally, it points to a notion of self-defense that is not confused with the right of resistance, since it is not the Lockean proprietary subjectivity, and which has a character of insurrection and that has an irreducible semantic-evaluative dimension.
