TORT LAW IN THE AREA OF FAMILY RELATIONSHIPS

Starting from a series of general questions in relation to family law, issues of civil liability within the family arising from the concealment of the true paternity and the consequences of such action are raised. The damage arises from the concealment that entails the belief of paternity and, consequently, the exercise of the whole series of rights and obligations associated with parental authority. Therefore, the basic question that arises is whether family relationships should be subject to civil liability and apply tort law to this area. This is a question that has been raised by the doctrine in recent times without reaching a consensus on the matter.
