COLLABORATIVE LAW: ANOTHER WAY OF RESOLVING DISPUTES

In this paper, a study of Collaborative Law and its particularities as a self-compositive way of resolving conflicts is carried out. Together with the analysis of its nature and main characteristics, the so-called collaborative procedure and the role played in it by all the participants, with the common objective of trying to deal with the resolution of disputes in a faster and more efficient way will be described. It will also allude, due to its practical relevance, to the distribution of costs involved in this alternative means of dispute resolution, as well as the various procedural vicissitudes (particularly the possibility and effectiveness of the use of declinatory proceedings) which may be faced by those who are faced with an agreement to submit to it prior to accessing the courts.
