摘要
Starting from the premise of the opening or internationalization of Constitutional Law, which allows the interaction of Brazil with other countries or systems, the study presents the origin of Comparative Law in the country and its doctrinal treatment, focusing on its function of assisting the judicial reasoning, specifically in the Federal Supreme Court (STF). The contribution of the doctrine of Professor Lucio Pegoraro is highlighted, with a perspective of greater scope after the translation of the work Comparative Constitutional Systems in Brazil. Presented the state of the art that touches the theme in Brazil, the article identifies a gap regarding the research and current doctrinal production, in order to understand the nature and scope of the comparative argument in the Brazilian constitutional jurisdiction. Finally, a proposal is formulated to improve the management of the comparative method in the Brazilian constitutional jurisdiction.
