摘要
All deliberation about what is recognized as justice is socially presupposed; That is to say, justice at first is what we recognize as social conscience. Before each event we deliberate about it, but the assumptions are already given and they condition our thinking. Thus, those who argue that immigrants should have rights in the United States because they pay taxes and make contributions to the economy agree with those who argue that migrants should have political rights in Mexico because they send remittances; Both cases are guided by a patrimonialist model of democracy that excludes the ethical criterion of the right to have rights, which is based on social justice. A second example is that of those who oppose immigrants having rights because they are not citizens of the receiving country, which coincides with those who oppose recognizing extraterritorial citizenship rights in the country of origin. "Scientific" literature is full of these types of deliberations.
