摘要：
In the ruling of 28 June 2022, in the case Commission / Kingdom of Spain (C-278/20), the Court of Justice of the European Union declared that Spanish legislation concerning the financial liability of the State legislature for damages arising from infringement of European Union Law makes it very difficult, if not impossible, for the individuals affected to obtain compensation and it is therefore contrary to the European Union principle of effectiveness. On the contrary, the Court rejected a possible infringement of the principle of equivalence. This study analyses the Spanish and European Union legal context and sets out the positive and negative aspects of the topic following this ruling.
