摘要
A The Cuban constitutional text of 2019 regulates as fundamental rights equality and nondiscrimination, human dignity and the free development of personality, laying the foundations to ensure effective equality between men and women and to combat discrimination and gender-based violence. This transcends the scope of Family and Criminal Law, since both branches of law must, from their framework of action, establish mechanisms to address behaviors that violate these fundamental rights. In this scenario, the recent enactment of the Family Code, as well as the entry into force of the new Criminal Code, constitute a great step forward, since both norms have addressed this phenomenon transversally with a gender approach that responds to the most current feminist currents both nationally and internationally, which is a great challenge for both the operators of the Law and for society in general. The present research intends to delve into the impact that feminist currents have had on Cuban Criminal Law, starting from Human Rights as an essential premise.
