PUBLIC PROCUREMENT LAW IN CHILE AND ITS DEFICIENCY IN ENERGY EFFICIENCY

This paper aims to analyse the regulation of public procurement in Chile, especially the 2023 reform, which substantially modifies the Law No. 19.886 about the Basis of Administrative Contracts for Supply and Provision of Services, incorporating within its modifications, a sustainability criterion to contribute to social, economic and environmental development. However, despite this major legislative advance, the environmental aspect has not been developed and, as a result, nor energy efficiency in public procurement, except for the non-binding rules of the Directorate of ChileCompra and other instruments, which are not mandatory for State agencies, a lege referenda being necessary to create at least a general legal framework in this matter.
