Judicial activism from the colombian constitutional court: an approach to the interpretative exercise and its implications in the legal system

Introduction: This research article highlights the importance of judicial activism, as well as the need for adequate judicial control over the rulings of the Constitutional Court. Although this activism represents a significant advance for the rule of law in Colombia, it is essential to analyze its impact and scope in the national context. Objective: to determine the characteristics, manifestations and effects of the judicial activism exercised by the Colombian Constitutional Court in the normative development and consolidation of the rule of law. Methodology: a qualitative documentary research methodology is used, based on the analysis of various pronouncements of the Court on the concept of judicial activism and its contribution to the evolution of different rights in Colombia. Conclusions: judicial activism has been determinant in the recognition and strengthening of fundamental rights, such as the right to abortion, the right to a healthy environment, gender equality, the right to die with dignity and the right to a survivor's pension for same-sex couples.
