Addressing Deepfake Pornography and the Right to be Forgotten in Indonesia: Legal Challenges in the Era of AI-Driven Sexual Abuse

摘要
Deepfake technology facilitates the alteration of a person's facial features in videos or images, frequently employed for non-consensual pornographic material disseminated on social media platforms. Individuals affected by deepfake pornography in Indonesia encounter significant obstacles in asserting their right to be forgotten, as specified in the Law on Sexual Violence Crimes. These challenges stem from a lack of implementing regulations, inadequate legal frameworks, and law enforcement practices that do not adequately consider gender issues. The absence of regulatory frameworks and the prevalent misuse of AI technology have resulted in a notable increase in incidents, with platforms such as Telegram emerging as key areas for disseminating altered content. Victims experience significant psychological, social, and economic repercussions. Although organizations such as the National Commission on Violence Against Women assist, there are still legal barriers that persist. In order to safeguard victims and implement the Right to Be Forgotten, Indonesia needs to tackle various legal, cultural, and enforcement obstacles, especially the insufficient gender sensitivity within law enforcement and the ambiguity surrounding relevant laws. A joint initiative involving both government and society is essential to protect victims' rights and address the increasing prevalence of deepfake pornography.
