PERSONAL AUTONOMY, SUCCESSION PLANNING AND FINANCING CARE FOR ELDERLY PEOPLE IN PORTUGUESE LAW

摘要
In this article we analyze the role that Succession Law can play in financing care for elderly people without close relatives who can provide this care and who live on their pension and own the house in which they reside, but do not have enough money to pay for such care. We conclude that an onerous succession contract could be introduced into Portuguese law as an adequate way of paying for such care. We also pay special attention to the protection of elderly people against undue influence in the making of wills and succession contracts.
