THE INTERPRETATION OF THE TAXACTIVITY OF THE ANS' LIST IN VIEW OF THE RIGHT TO HEALTH OF PEOPLE WITH AUTISM SPECTRUM DISORDER

摘要
This article analyzes whether the interpretation of the list of procedures of the National Supplementary Health Agency (ANS) is compatible with the legal system and with the right to health of people with autism spectrum disorder (ASD). Through the hypothetical-deductive method of approach and bibliographic-documentary source, the health requirements of people with ASD are investigated; based on the judgment of EREsp 1.886.969/SP, the foundations of the thesis of taxativity; if such reasons proceed formally and materially; and if there is another way of interpretation that is more congruent with the protection system of these subjects. It is concluded that the thesis of taxation causes several health problems for people with ASD, and must be overcome in jurisprudence by the thesis of exemplarity.
