摘要
The judiciary control of the administrative discretionarity is a polemic issue which remains with no objective answers. Traditionally, the scholars understand that the judge only can control the legal aspects of the administrative discretionarity. Nevertheless, the contemporary discussions renovate and dimension the question of the possibility of the control and in which cases it is admitted. This essay intends to show that is possible to the judiciary branch to control the administrative acts based on the correct hermeneutic and constitutional principles.
