IMMIGRATION LAW AND JURISPRUDENCE OF THE CONSTITUTIONAL COURT, THE EUROPEAN COURT OF HUMAN RIGHTS AND THE COURT OF JUSTICE OF THE EUROPEAN UNION (2012-2013)

The aim of this paper is to group together the most important rulings with regard to Immigration Law by the Constitutional Court, the European Court of Human Rights and the Court of Justice of the European Union between July 2012 and June 2013. In these months the Constitutional Court has ruled on the action of unconstitutionality against one of the reforms to Organic Law 4/2000. Similarly, the European Court of Human Rights has ruled on Articles 3 and 8 of the European Convention on Human Rights as setting limits to deportations. In another ruling, it has also condemned Spain for discrimination against a Nigerian citizen. Finally, the Court of Justice of the European Union has continued with the process of interpreting the European system of asylum, especially with regard to the Arslan ruling.
