The French law of 22 April 2005 most appropriately recalled the subjectivity of the terminally ill patient, completing the law of 5 March 2002 concerning patients' rights. The question now becomes one of the impact of legal claims on our evaluation of healthcare practices. There may be a risk of masking, by an effect of mode or decisional comfort, the interrogations concerning the moral uncertainty of good actions. In this light, excessive reference to the legal framework might overshadow the ethical issues so inherent in certain decision making processes. (C) 2008 Elsevier Masson SAS. Tous droits reserves.
