LEGAL STRUCTURE OF THE ENSLAVING TRANSACTION: THEORY AND PRACTICE ISSUES

摘要
Article is devoted to the analysis of qualifying signs of the enslaving transaction. The various points of view which are available on the matter in legal literature, and also in jurisprudence materials are considered. In the presence of, apparently, accurate definition of the enslaving transaction which allows to allocate its qualifying signs, in scientific literature, and also in jurisprudence there was no uniform approach to definition of quantitative structure of signs of the enslaving transaction, and also their uniform understanding. In work changes in the Civil code of the Russian Federation which now are on consideration in the State Duma of the Russian Federation are analysed. In principle new edition of Art. 179 of group of companies repeats the previous on sense. Its unique difference is allocation of concept of the enslaving transaction in separate point of article. An innovation is the instruction in article on possibility of application of rules about enslaving transactions to the transactions made by the citizen on the extremely unprofitable conditions owing to inexperience in affairs, levity or weak will. Thus, the legislator even more expands scope of a design of the enslaving transaction, namely the transaction can be recognized enslaving not only in case of compelled its commission owing to confluence of serious consequences on the extremely unprofitable conditions for the victim, but also as a result of levity, inexperience, and also weak will. It is thought that adoption of article about enslaving transactions in such edition even more will separate courts at application of this norm. Unfortunately, developers of the new Civil Code didn't consider the developed tendencies to ambiguous interpretation by vessels of concept of the enslaving transaction. Thus, the author comes to a conclusion about lack of a uniform approach to concept of the enslaving transaction and its qualifying signs not only in scientific literature, but also in jurisprudence that leads often to impossibility to prove commission of the enslaving transaction. Elimination of existing shortcomings of the legislation in his opinion will allow to result in uniformity practice of application of a design of the enslaving transaction.
