摘要：

This article, which is the beginning of the search of the course completion work aims to demonstrate that although, by definition, judicial activism seem pejorative, it has some positive aspects which can greatly influence both the law as life people, when analyzed under the approach that consists of the counter-majoritarian jurisdiction for litigation of public interest.
