摘要
Some say today that the law is in crisis, and that the legislative activity is insufficient and ineffective with regard to the new demands of society. The liberal legalistic model, which was believed for a long time to be the essential basis of the rule of law, is no longer an element of ensuring social justice. This is a high theoretical content problem and caused by, distinct and several very complex factors. To solve this problem, it seems necessary to rescue the classic debate between legality and legitimacy, in order to try to provide diagnostic and sensible answers to new social, ethical, political and legal challenges that arise in contemporary democratic societies. The approach to this fundamental question is the theme of this book, which is actually a compilation of ten works of various authors. Their different theoretical approaches in the large areas of philosophy, morality, politics, sociology and law, guarantee a plural and well-reasoned approach. It is not a mere accumulation of independent texts, but rather a collection that responds to a coherent and consistent logic, due to the brilliant work of its editor, Professor Dr. Juan Antonio Gomez. The book is, above all, an enjoyable read and perhaps one of the most interesting works produced in recent years on the issue of legality and legitimacy.
