SOCIO-CULTURAL GENDER INEQUALITY FROM A PRAGMATIC APPROACH

We are universally equal, no matter color, race or social status; we are all equal: men, women and children. We have different physiological and anatomical characteristics but as a whole, human beings. In law, there is no limitation between men and women because everybody is entitled to enjoy, live, smile, love, cry, dream, among others. The 4th Article of the Mexican United States Political Constitution establishes that men and women are equal to law, but actually, they do not have the same opportunities. There is a social deficiency in the legal concept of gender equality. This does not mean laws are effective or the different legislations do not provide for the recognition of gender equality as an inherent right to human being; but when the State recognizes and protects them in the law, which will establish the bases of social coexistence. At present and in the past, our human essence has been broken, being both, the State and the society co creators of stereotypes that link the social roles of men and women; so, the position of women has been reduced, undermining her legally recognized human rights.
