SCHOOL EDUCATION, ALTERITY AND LIFE JUDICIALIZATION IN CONTEMPORANEITY

This article seeks to present an understanding of the construction of expectations concerning the legalization of daily school life and how they reflect the social relations in contemporary. Therefore, we attempted to analyze this phenomenon from the discourse about the crises of otherness in the contemporary times that seems to predispose the people to bet on the legalization as a solution to the problems experienced at school. We understand that the school is a privileged locus for the creation of relational spaces that facilitate the exercise of otherness, living with differences and the recognition of the other what can give a new meaning relations according to a logic that escapes the commodification of life. From this point of view, it is considered that address the issue strictly according the perspective of legalization would seem to to waste this privileged space of the school encounters with others (and increasingly scarce nowadays). It is concluded that without claiming that the school offers totalizing answers, on the other hand, the outsourcing of the resolution of this issue to the judiciary, which will serve as one subsuming logic of school conflicts to legal parameterization and delimitation of victims and perpetrators, can either reach the effectiveness of an educational practice committed to the issue of otherness.
