摘要
In the present paper arguments are given, from the positive law perspective and the instutitional logic point of view, in order to justify the legitimacy of the jurisdictional control on the Autonomous Statute of Catalonia by the Constitutional Court. Additionally the paper analyzed the interpretive limits to the Constitututional Court, pointing out what could not be the object of his judgment and which are the main topics that should be answered by the Court. Finally some considerations are made about the judgment consequences, as would be the derogatory effects over the legal norms already adopted by the autonomous Parliament or the hypothetical attempt to elude the judgement through the adoption of basic legislation by the State.
