Australia has adopted a novel approach to human rights protection. Rather than developing a court-focused model, it has built upon laws in the United Kingdom and elsewhere to emphasise the role of Parliament. However, the Human Rights (Parliamentary Scrutiny) Act 2011 (Cth) takes this a major step further in providing the Australian Parliament with the exclusive role of ensuring human rights protection. This offers a unique opportunity to assess the capacity of Parliament to protect human rights without court involvement. This article examines the role of the Australian Parliament in protecting human rights generally, before assessing Australia's new exclusive parliamentary model of rights protection.
