摘要
We analyses the decision Klein vs. Russia of the European Court of Human Rights (ECourtHR) in the case of an Israeli citizen sought in extradition to Colombia for the execution of a sentence for the training of paramilitary forces. The decision is presented in the broader framework of the ECourtHR's jurisprudence on extradition cases from European third states where the risk of human rights violations exists. We develop the principles applied by the ECourtHR in these cases and verify their application in the Klein vs. Russia case, taking into account also the dissenting opinion. In the conclusions we develop an idea of how impunity of perpetrators of human rights violations can be avoided when they cannot be extradited for humanitarian reasons.
