Policy Power on the Institutions of Higher Education: Administrative Procedures of Supervision and Evaluation

It is desired, with the present work, the study of the supervision and evaluation procedures of higher education, existing in the Decree n degrees 5.773/06, under the prison of the Constitution of the Republic of 1988 (GR/88) and of the law n degrees 10.861/04, that instituted the National System of Evaluation of Higher Education (SINAES). One is a preponderantly theoretical-documentary work, under a dogmatic perspective. One has concluded that, in the case of closing of Institutions of Higher Education (IES), the rights of the students registered at the end of the degree still deserve administrative regulation. In addition, the procedure for the application of penalties to the institutions that have not reach the commitment protocol, previous periodic process of evaluation of the SINAES, is illegal and unconstitutional to violate sic 3 degrees and 4 degrees, of article 10, the Law n degrees 10.861/04.
