摘要：

This paper discusses the judicial review of public policies in the Brazilian Supreme Court. The parameters are texts of authors who write about the limits and crises of the Welfare State and the concept of legitimacy of reflexivity (Pierre Rosanvallon). The hypothesis is that the precedents of the Supreme Court that deal with public policy present a deficit of legitimacy. These cases are intended to be perfectionists, but fail to incorporate the facticity through the principles and to respect the integrity of Law. This means that these cases do not observe the legitimacy of reflexivity.
