The Carl Schmitt's Doctrine on International Law

In this contribution we identify three fundamental axes capable of structuring Carl Schmitt's thought on international law: (i) spatial ordination; (ii) war and (iii) the limitation of war. The structure proposed here makes more intelligible the doctrine of Schmitt compared to other attempts to study international legal thought of German jurist (for examples, Campderrich, Fernandez Pardo, Kervegan). Also, we show how with our interpretation is possible, in principle, to make vague aspects clearer on Carl Schmitt's thought on international law. This aim to be a contribution to the History of International Legal Ideas.
