LABOR DISPUTES AND CONFLICTS OF INTEREST IN THE RUSSIAN FEDERATION LEGISLATION

摘要
The issue of the correlation between the labor disputes and conflict of interest in the Russian Federation is researched. It is noted that labor disputes as the scientific juridical notion and the phenomenon of the legal reality have always been in the center of attention of the labor law professionals, and they are rather well-characterized in relation to the definitions, classifications, ways of solution etc. The conflict of interest is a relatively new legal category and it was originally fixed in the state civil service legislation, and later in other acts regulating different types of services. For this reason, it was insufficiently researched by the labor scientists. In 2010, Article 3491 was introduced into the Labor Code, dedicated to setting the details of regulating the labor of the state corporations' and companies' employees who faced a conflict of interest. This is why this term was directly included into the labor law subject and deserves thorough study. For this reason, the common features are analyzed typical for the labor disputes and conflict of interest, their differences in the subject matter, contents, ways of solutions etc. The conclusion is made that there is an opportunity to unite the labor disputes and the conflict of interests in common notion "labor conflicts", dividing this into labor disputes and conflict of interests with the corresponding definitions and classifications. It is proposed to introduce some changes and make amendments to the Labor Code of the Russian Federation.
