THE ADMINISTRATIVE MEDIATION. SOME PROPOSALS FOR ITS IMPLEMENTATION IN THE ADMINISTRATIVE AND PROCEDURAL LEGAL REGIME

The target of this work is to present the administrative mediation as a way to resolve conflicts between Government and citizens. Nowadays the experiences that are developing in Spain, stimulate the interest and the need to know the resolution conflicts technique. It possesses the support and the impulse from the Department of Justice, the Council General Judiciary and from other autonomous administrations. The objections that << a priori >> might appear against the recognition and efficiency of putting in practice the administrative mediation, taking into account the limits derived from the administrative legal authority and the characterization of the prerogative or the unilateral act, have been yielding in favour for the conflict resolution mechanism that allows to create communication links and dialog, offering imaginative solutions under a new culture of peace, which must operate normally in the administrative legal relations.
